The Military Prosecutor’s Office of Rome clarifies that “it has not initiated any investigation against General Roberto Vannacci for the alleged reconstitution of the fascist party, nor has it indicated such a hypothesis as the object of the investigations ordered. The same Prosecutor’s Office, in justifying its decision, in fact specified that it was deemed appropriate to order ‘preliminary investigations aimed at clarifying in what context the facts should be framed and to verify the existence of any cases of interest to this Office,’ also noting that ‘the vagueness of what has been highlighted does not allow – at this stage – to proceed with formal registrations in the register referred to in art. 335 cpp.’ This is an unequivocal passage: no formal registration has been ordered in the register of crime reports, nor has a criminal investigation been initiated against General Vannacci. It is also necessary to specify that in the complaint submitted to the Military Prosecutor’s Office by the Military Union no hypothesis of reconstitution of the fascist party is formulated and no reference is made to the Scelba law.”
The investigations ordered by the Prosecutor’s Office concern, “as expressly indicated in its statement, the position of members of the Armed Forces within the organizational structure of Futuro Nazionale, in order to verify the possible existence of facts strictly within the jurisdiction of the military courts. Therefore, the headline stating that the ‘Military Prosecutor’s Office initiates investigation on Vannacci’ for the ‘reconstitution of the fascist party’ is a representation that finds no support in the Prosecutor’s Office documents. In fact, an investigation is being attributed to the judicial authority that does not appear to have been initiated, a hypothesis – that of the reconstitution of the fascist party – which is not contained in the complaint to the Military Prosecutor’s Office, and a registration in the register pursuant to art. 335 c.p.p. which the Prosecutor’s Office itself expressly states it has not made. The distinction is not formal, but substantial. And, given the seriousness of the accusation evoked, it cannot be ignored nor transformed into a journalistic headline that presents as an established fact what, in the official documents, simply does not appear.”
