The clash between the judiciary and the government returns, at least among a part of the magistrates, those who identify with the Anm, the most barricaded and hostile union to the center-right, promoter of the No to the referendum last March. The tensions are fueled precisely by the case of Mario Roggero, recipient of a very heavy sentence, at 72 years old. “The issue of assaults and violence against shopkeepers or in private citizens’ homes cannot be underestimated, but this rather pertains to the profile of crime prevention and territorial control,” ruled the president of the Anm Giuseppe Tango. “I would like to remind that the law already provides the sacred institution of legitimate defense, but it cannot tolerate private revenge. Saying otherwise means undermining the foundations of the rule of law and those who represent the institutions should know this well,” added the magistrate.

The magistrates’ union particularly takes issue with the words of the Minister of Defense, Guido Crosetto, who declared on X that for years there has been “jurisprudence that interprets laws to the point of distorting them and it has been allowed to release even murderers of state servants after a few years,” while what happened to Roggero is not only unjust but also “hard to accept.”
Tango’s reply is harsh, for whom the minister’s statements are “surprising as he calls for the judge’s power to innovate laws, a task that belongs solely to the legislator, while at the same time delegitimizing the judiciary with accusations of double standards as hateful as they are generic.” The minister is also attacked by Unicost: “Words harmful to the law.”

The attack on the center-right was then taken up by the Pd deputy, Laura Boldrini: “Once again, Salvini and Meloni are scavenging on a news case to fan the flames of the security issue and to chase Vannacci. The Cassation’s ruling on the Roggero case is clear: it was not legitimate defense. And it is worth remembering that it is precisely based on the law wanted by Salvini, approved with the slogan ‘defense is always legitimate,’ that the judges reached this conclusion in three levels of judgment.”
