From the famous “clockwork justice” we have arrived at “on-call investigations.” This is what one might think reading the latest statement from Democratic Party senator Francesco Boccia against the government. The aftermath of Giuseppe Conte’s hearing in the Covid commission is evident. Especially after the former prime minister tried to overturn the table, presenting a document that, according to him, would prove that the decision to terminate the contract with the company Jc Electronics for the supply of masks was correct. Consequently, the executive decision by Giorgia Meloni to close the legal dispute with a 100 million settlement with Jc Electronics would appear rash after the ruling 17025/2024 of the XVI civil section of the Rome Tribunal condemned Italy to pay compensation of over 200 million.

To try to refute the rulings that have already gone against Italy, the M5S leader handed the act to the Prosecutor’s Office. “The investigations initiated by the Rome Prosecutor’s Office after the complaint filed by President Conte confirm how necessary it is to shed full light on the JC Electronics case and the transaction of over 100 million euros. Without anticipating judgments that belong exclusively to the judiciary, it is evident that the questions we raised in recent months were anything but pretextual,” wrote the Democratic senator who sits on the Covid commission. But how? Have the investigations already started? And how does Boccia know? These questions have also arisen among those sitting just a few seats away from him on the commission. “The statements by Democratic senator Francesco Boccia, who in a press release claims that investigations have started by the Rome Prosecutor’s Office after the complaint filed by Giuseppe Conte on the JC issue, can only cause strong perplexity,” wrote Fratelli d’Italia senator Antonella Zedda. The problem is evident: “Leaving aside the merits of the case,” explained the Meloni party member, “it is clear that this statement raises a series of issues on which clarity is necessary.
Excluding that the Rome Prosecutor’s Office acts “on demand” or at the explicit request of a political force, how is it possible that just a few days after the complaint was filed, Boccia claims that the Prosecutor’s Office has already activated investigations?” As Zedda points out, “we remember dozens of complaints filed and left pending precisely at the Rome Prosecutor’s Office and about which nothing more was heard.” These considerations lead the Fratelli d’Italia group to demand transparency on these statements: “Clarity is needed on what would otherwise translate into an improper instrumentalization of the judiciary.” Although, as Libero has ascertained, that document – which Conte said he received anonymously – consists of reports already examined by the judiciary, for Boccia “there is a transaction of over 100 million euros of public money on which increasingly serious questions have arisen.” For this reason, Elly Schlein’s left-hand insists on asking the Minister of Health to transmit “the agreement, the opinion of the State Attorney’s Office, the appeal and suspension acts, the investigative documentation, the correspondence exchanged between the parties, the acts relating to financial coverage and payment” regarding JC Electronics. The focus is on the passing of responsibilities between the Ministry and the Covid commission after the opposition’s question: “We ask Minister Schillaci,” Boccia concludes, “to follow up on the availability he has expressed and to make available to Parliament all the acts under the Ministry of Health’s competence that can be transmitted.
