At the heart of the matter are the agreements signed with Francois Gelmetti and Valentina Dadda, classified respectively as a collaborator and a VAT number holder instead of employees. A choice that, according to the Milan court, did not reflect the real employment relationship, so much so that judge Franco Caroleo concluded that both were actually “fixed-term employees”.
Among the elements under scrutiny are the conditions provided for in the contracts, which allowed for the immediate termination of the relationship even for reasons such as “repeated absence more than twice from coordination meetings“.
